This Indenture made the fifth day of June in the year of our Lord one thousand eight hundred and ten between Hugh Holmes and Elizabeth his wife of Winchester Frederick County Virginia of the one part and Robert Kerlin of the same place of the other part, witnesseth that for and in consideration of the sum of one hundred and twenty dollars current money of the United States in hand paid by the said Robert Kerlin at or before the sealing and delivery of these presents, the receipt whereof they hereby acknowledge and thereof do release, acquit and discharge the said Robert his Executors and administrators, by these presents, the said Hugh Holmes and Elizabeth his wife have granted, bargained, sold, aliened,released and confirmed and by these presents *so* grant, bargain, sell, alien, release

confirm unto said Robert Kerlin and his Heirs forever a certain piece or Lot of Land situate in the said County of Frederick being a part of one hundred and eight acres, tract granted to William Cockran by Lord Fairfax March 5, 1760 and by said Cockran conveyed to Lewis Wolfe and by the said Lewis Wolfe *deceased* to his daughter Elizabeth who intermarries with Geo. Neville and conveyed to the said Hugh Holmes by deed bearing date the 6th July 1805 and recorded in the district Court then *holden* at Winchester. This Lot is known by N.10 in a plan of devision made by the *moiaty* of said 108 acres by Jn. Brown *D–C* and bounded as follows. Beginning at a stake at the south west corner of Lot No.8 thence N.25 E. 17 ps to a stake, thence N65 37 7/10 poles to a stake, thence S25 W 17 ps to a stake, thence S65 E 37 7/10 ps to the Beginning containing *four* acres with the benefit of a public ally 12 feet wide leading to the same and all houses buildings orchards ways waters water*courses* profits commodities *inedita-ients* and appurtenances whatsoever to the said premises hereby granted *or* any part thereof belonging or in any wise appurtaining and the Reversion and Reversions, Remainder and Remainders, Rents, Issues and Profits thereof and also all the estate, right, title, interest use *trust* property and demand whatsoever of the said Hugh Holmes and wife of in and to the said premises and all Deeds, *evidences* and writings touching or in any wise concerning the same. To have and to hold the Lands hereby conveyed and all and singular *other* the premises hereby granted and released and every *po-it* and *pai-ce-* thereof, with *the* appurtenances, unto the said Robert Kerlin his heirs his assigns forever to the only proper us and Behoof of him the said Robert Kerlin and of his Heirs and Assigns forever and the said Hugh Holmes and Elizabeth his wife for themselves their Heirs, executors and administrators do covenant promise and grant to and with the said Robert Kerlin his Heirs and assigns, by these presents, that the said Hugh Holmes and Elizabeth now at the time of sealing and delivering these presents are seized of good, sure, perfect and indefeasible estate of inheritance in *Ric Simplo* of and in the premises hereby granted and released and that they have good power and absolute authority to grant and convey the same to the said Robert Kerlin in manner and form as *aforesaid*

Between Robert Kerlin and Hannah his wife of the county of Frederick + state of Virginia of the one part, and Ann Kean widow and *–* of John Kean dec’d and Joseph Kean Robert B. At a Court of Common Pleas begun and held at Steubenville, in and for said County of Jefferson, on Monday the 28th day of August A.D. 1843, among other proceedings had at said Court was the following, to wit.

In the matter of the
Last Will and Testament
of Hannah S. Kerlin, dec’d

This day a paper writing purporting to be the last Will and Testament of Hannah S. Kerlin, late of the County of Jefferson, deceased, was brought into Court and William Hamilton, a subscribing witness thereto, being first duly sworn , and the said paper writing being exhibited to him he did depose and say “I saw the said Hannah S. Kerlin (dec’d sign said paper writing as and for her last Will and Testament, I signed the same as a witness in her presence and at her request, the said Hannah S. Kerlin, at the time of the signing thereof was of sound mind and memory, of the full age of twenty one years and was under no restraint.” And Joseph Kitchcart, another subscribing witness to said paper writing having the same exhibited to him and being also

duly affirmed he did depose and say “I saw the said Hannah S. Kerlin, deceased, sign the said paper writing as and for her last Will and Testament. I signed the same as a witness in her presence and at her request, the said Hannah S. Kerlin, at the time of the signing thereof was of sound mind and memory of the full age of twenty one years and was under no restraint.” And the Court being satisfied that the said paper writing had been duly executed published and declared by the Hannah S. Kerlin in her lifetime as and for her last Will and Testament the same is admitted to probate and together with the foregoing evidence ordered to be recorded. Thereupon Henry T. Kerlin the Executor named in said Will and residuary legatee appeared in the open Court and took upon himself the execution of said last Will and Testament. Bond ordered to be given in the sum of Five hundred dollars ( $500-) Joseph Kitchcart and William B. Kerlin were approved of as securities.

In the name of the Benevolent Father of all. I Hannah Stephens Kerlin of Mountpleasant in the County of Jefferson and the State of Ohio do make and publish my last will and testament.

Item First. It is my will that all my just debts and funeral expenses be fully paid.

Item Second, I give devise and bequeath to my son Robert A. Kerlin One hundred dollars to be paid when a sufficient quantity of my property is disposed of after complying with the first item ( above).

Item Third. I give devise bequeath the residue of my estate real and personal to my son Henry T. Kerlin and to his heirs forever.

Item Fourth. I do hereby nominate and appoint my son Henry T. Kerlin executor of this my last Will and testament hereby authorising and empowering him to compromise adjust release and discharge in such manner as he may deem proper the debts and claims due me.

In testimony whereof I have hereunto set my hand and seal this thirteenth day of March In the year of our Lord One thousand eight hundred and forty three.

April Term 1827

The Master Commissioner of this Court to whom the account of Joseph Gill and John Watson Administrators of Robert Kerlin dec. was referred reports that (?) he has examined said account and finds that the (?) Administrators have received from the sale (?) of real and personal estate including interest Three hundred and eighty nine Dollars + ninety six cents. That the costs of Administrators amount to fifty seven Dollars + eight cents. Which leaves for the payment of debts three hundred and thirty two dollars and eighty eight cents. That the claims against the estate amount to one thousand seven hundred and eighty five Dollars and fifty three cents which leaves a deficiency of one thousand four hundred and fifty three Dollars and sixty four cents. The Master further reports that the said sum of three hundred and thirty two Dollars and eighty eight cents when duly apportioned amongst the several creditors will pay eighteen cents and five mills on each Dollar of the aforesaid demand. Ordered by the Court that the said account be and the same is accepted by the Court and it is further ordered that the Administrators pay to the creditors agreeably to the above apportionments.
